Please read these Terms and Conditions carefully before using the soundbuddy.co.uk website operated by Sound Buddy.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these terms.

These terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms.
If you disagree with any part of the terms then you may not access the Service.

No statement or condition of sale contained within these terms affects or restricts your statutory rights as defined under The Consumer Contracts Regulations 2014.

All orders for goods accepted by Sound Buddy (the vendor) are accepted subject to the following conditions, which shall form part and govern the contract of sale.

Acceptance of goods by the customer shall be deemed to be acceptance of these conditions of sale unless the customer notifies Sound Buddy in writing within 15 days of receipt of this letter or delivery of goods.

Any term sought to be imposed by a customer either in a document or otherwise that conflicts with or adds to these conditions is not accepted.

No agent or representative of Sound Buddy has authority to vary these conditions.

We store the content of this contract and will send you the details of your order as well as our general terms via email.

You can find the terms here at all times. The details about your recent orders can be found in your customer login.

 

CONTENT

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material.

 

LINKS TO OTHER WEBSITES

Our Service may contain links to third-party web sites or services that are not owned or controlled by Sound Buddy.

 

PRICING ERRORS ON THE WEBSITE

Every effort is made to ensure the accuracy of the prices on the website. In the event of a pricing error on the website then Sound Buddy will not be bound to honour any orders made at that price and any orders received will be deemed as offers to buy and not acceptance of any offer.

 

CHANGES

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

 

TERMS OF PAYMENT

For orders placed using Credit or Debit cards, the payment card will not be debited until the order is actually dispatched.

 

SHIPMENT OF ORDERS

Sound Buddy shall not be bound by a contract of sale until the goods have been received by the customer.

As indicated on the product page, delivery dates are provided as an estimate only - Sound Buddy will use its best endeavours to comply with the date named for delivery.

Many products are held in stock by Sound Buddy, but in some cases the date stated is an estimate of the time it will take to order the item from the manufacturer and deliver it to the customer.

Sound Buddy reserves the right to part ship orders but will not charge more than the total advertised delivery price for delivery of the order in full.

 

GOODS DAMAGED IN TRANSIT

Any goods received by the Customer that have suffered damage in transit must be reported to Sound Buddy as soon as possible, and at the latest within 14 days of receiving the goods.

Sound Buddy will collect damaged goods from the Customer and deliver replacement goods as quickly as possible at its own expense.

Sound Buddy accepts responsibility for the condition of the goods until they are delivered to the Customer, so any damage or breakage en route is in Sound Buddy’s responsibility, but if something happens after it has been delivered to the Customer, the Customer’s dedicated safe place or the Customer’s nominated neighbour, is the Customer’s responsibility, and Sound Buddy cannot accept any liability for damages.

Sound Buddy will not accept any responsibility for goods damaged in transit if the customer reports the damage more than 14 days after receiving the goods.

Sound Buddy will reimburse reasonable return costs should the Customer be able to provide independent proof that the damage is attributable to Sound Buddy or its instructed courier.

If despite appropriate and secured packaging, the Customer’s returned goods are damaged during transit from the Customer to Sound Buddy, Sound Buddy will take responsibility if the collection and delivery have been arranged and facilitated by Sound Buddy.

If the Customer has arranged to send the item back to Sound Buddy at the Customer’s expense, Sound Buddy accepts no liability and the Customer will need to contact his courier company for any compensation for loss of refund or rely on his chosen transport insurance.

 

DELIVERY OF THE INCORRECT ITEM

Any goods received by the Customer that the Customer considers as the incorrect delivered goods must be reported to Sound Buddy as soon as possible, and at the latest within 14 days of receiving the goods.

Sound Buddy will collect incorrect goods from the Customer and deliver replacement goods as quickly as possible at its own expense.

The Customer has a responsibility to return the incorrect item or any item that has been accidentally delivered to the Customer by Sound Buddy without order or payment.

If the Customer doesn’t return it, Sound Buddy will charge the Customer the full cost of the item.

 

CANCELLATION OF ORDERS

The Customer has a right to cancel an order for items purchased from Sound Buddy's website or placed over the telephone or by email no later than 30 days after delivery.

Orders can be cancelled by letter, email or telephone.

Items need to be returned no later than 14 days from the day on which the Customer communicated the cancellation to Sound Buddy.

There are some restrictions to products that can be cancelled after delivery however as follows:

Items that come directly into contact with the nose, ears or mouth, such as in ear monitors or woodwind reeds;

Items personalised or made to a specific specification or configuration for the Customer, including computer systems, studio packages, audio or video production suites;

Items that have been mixed/installed inseparably with other items after delivery or modified in any way.

Customer orders that include goods designed to work together as a unique package of the Customer’s choice and require specific testing or setup by Sound Buddy may not be cancelled without the specific agreement of Sound Buddy, and will be subject to a cancellation fee.

Sound Buddy may cancel any order placed by a Customer until the goods are received by the Customer if Sound Buddy is no longer able to supply the item, there has been a significant price change of the item, or if Sound Buddy suspects the transaction is fraudulent. If an order is cancelled by Sound Buddy any monies paid by the Customer will be refunded in full within 10 days.

 

RETURNS:

Products may be returned for a full refund within 30 days of delivery.

Providing the Customer informs Sound Buddy within 30 days of delivery to the Customer, Sound Buddy will refund standard delivery charges.

Collection requests made for cancelled orders will incur a collection charge, the amount of which depends on the size and weight of the item.

Delivery charge refunds and free collections exclude delivery upgrade options including installation, two-man delivery, timed and Saturday services.

When Sound Buddy receives returned goods they will be inspected to ensure all manuals, accessories, free items and any other components are within the returned package and that the Customer has taken reasonable care of the goods and also taken reasonable care to ensure the goods are appropriately packaged for safe transportation back to Sound Buddy.

If Sound Buddy receives goods that have not had reasonable care taken, Sound Buddy shall charge the Customer a fee equivalent to the reduction in the value of the goods, or 10% of the purchase value, whichever is the higher.

If the goods have missing manuals, accessories, free items or any other components, Sound Buddy shall charge the Customer the cost of the missing items.

These costs will be deducted from any refund that is due to the Customer.

If items are returned within 30 days from delivery without the original boxes and packaging a re-stocking charge will be applied.

Some items are only eligible for money back guarantee if they are returned to Sound Buddy unused and sealed in the original packaging.

These items include:

  • In-Ear Headphones and In-ear Monitors
  • Earplugs and Ear Protection
  • Mouthpieces, Reeds etc. for Woodwind and Brass instruments
  • Mouth / Lip Care Products

Sound Buddy is unable to accept returns of any custom-made items.

Exceptions may only be possible with prior agreement of Sound Buddy, and may be subject to a cancellation and restocking fee of 25% minimum, providing the goods are in original stock condition.

 

COMPLAINTS

In the event of the customer needing to make a complaint, firstly they should email sales@soundbuddy.co.uk. In many cases, a complaint is best resolved by the person responsible for the issue in question.

If the complaint has been received by that person, they may be able to resolve it swiftly and will do so if possible and appropriate.

The acknowledgement should say who is dealing with the complaint and when the person complaining can expect a reply within 7 days.

 

DEFECTIVE GOODS:

If items become defective due to manufacturing fault within 180 days of purchase, then Sound Buddy will arrange for the collection and repair of the product entirely at Sound Buddy’s cost.

If the product can not be repaired within 60 days, then a replacement product will be issued, which will not be older and not be in worse condition than the original product returned by the Customer.

If the item becomes defective within the warranty period, but after 180 days from the date of delivery, then the same conditions as above apply but the Customer will be expected to pay for any reasonable steps to prove the manufacturing fault and for the cost of returning the product to Sound Buddy.

Products may not be returned to Sound Buddy for a refund later than 30 days from delivery unless Sound Buddy is unable to comply with its warranty obligations.

This warranty excludes items that have become defective due to misuse, accidental damage or any reason other than manufacturing fault.

If an item is found to be without fault on its return to Sound Buddy, and is out of the period of 30 day money back guarantee, then Sound Buddy will return the item to the Customer for a small charge.

Sound Buddy recommends that the Customer insures his goods.

 

LIABILITY

Sound Buddy is not liable for loss of business or income under any circumstances.

Whilst Sound Buddy makes every effort to ensure that goods supplied correspond to in every respect with the specification or description provided as the case may be, Sound Buddy is not responsible for minor variations in specification, and no such minor variation shall be the subject of any claim against Sound Buddy.

Sound Buddy will take all reasonable care, in so far as it is in its power to do so, to keep the details of the Customer’s order and payment secure, but in the absence of negligence on Sound Buddy’s part, Sound Buddy cannot be held liable for any loss the Customer may suffer if a third party procures unauthorised access to any data the Customer provides when accessing or ordering from Sound Buddy’s Websites.

 

DEFECTIVE GOODS:

If the product becomes defective due to a manufacturing fault within the warranty period, Sound Buddy will arrange for a free return.

After two years, the Customer is responsible for the cost of returning the item to Sound Buddy and the cost of delivering the item back to the Customer.

Sound Buddy will reimburse reasonable return costs should the Customer be able to provide independent proof that the fault is attributable to Sound Buddy or the manufacturer.

 

MONEY BACK GUARANTEE:

Subject to the warranty exclusions as detailed in this document, products may be returned for a full refund within 30 days from the delivery date.

The Customer must send the products back to Sound Buddy, or alternatively Sound Buddy can arrange collection for a fee depending on the size and weight of the item.

Any standard delivery charges applied to the Customer’s order will be refunded.

When Sound Buddy receives returned goods they will be inspected to ensure they are in as new condition, and all manuals, accessories, free items and any other components are within the returned package and that the Customer has taken reasonable care of the goods.

The Customer must take reasonable care to ensure the goods are appropriately packaged for safe transportation back to Sound Buddy.

If Sound Buddy receives goods that have not had reasonable care taken, Sound Buddy will charge the Customer a fee equivalent to the reduction in the value of the goods, or 10% of the purchase value, whichever is the higher.

These costs will be deducted from any refund that is due to the Customer.

 

REFUNDS AND EXCHANGES

We hope you will be pleased with your purchase. Should you wish to return anything bought from us, we will be happy to refund or exchange a product provided it is in a fully resalable condition.

Returns should be made within 30 days and in original, undamaged packaging. If we find that the product has not been returned us in fully resalable condition, we reserve the right to refuse a refund on the item If you are returning an item because of an error on our part or because it is damaged or defective, we will refund the delivery charges incurred in sending the item to you and pay your costs of returning it to us.

If despite appropriate and secured packaging, the Customer’s returned goods are damaged during transit from the Customer to Sound Buddy, Sound Buddy will just be able to take responsibility if the collection and delivery have been arranged and facilitated by Sound Buddy.

If the Customer has arranged to send the item back to Sound Buddy at the Customer’s expense, Sound Buddy accepts no liability and the Customer will need to contact his courier company for any compensation for loss of refund or rely on his chosen transport insurance.

 

COLLECTION AND DELIVERY COSTS:

If goods become defective within the first 180 days of the Customer’s ownership, Sound Buddy will collect the goods from an address the Customer specifies and deliver them back to the Customer free of charge.

After 180 days of ownership Sound Buddy will make a small charge to contribute towards its direct costs of collecting and returning the goods back to the Customer.

 

TRANSFER OF WARRANTY:

Sound Buddy must be advised by email of the new owner's details including name, address, email address and telephone number within 30 days of the item being sold. Failure to do so will invalidate the warranty and no claims may be made by the new owner.

 

REPLACEMENT PRODUCTS:

In the event that an item cannot be repaired within 60 days, then an equivalent replacement item with similar functionality will be supplied. Replacement items may not necessarily be new, but will be fully functional and will not be older than the item they replace. Replacement products will not be more expensive than the product they replace. Suitability of replacement products shall be discussed with the customer, but the final decision on their suitability shall be made by Sound Buddy.

Any repair or replacement of a defective product will not renew or prolong this warranty beyond the original expiry date of the warranty.

 

WARRANTY EXCLUSIONS:

This warranty is designed to cover manufacturer defect. If the item fails for any reason not due to manufacturer defect, including any of the following reasons then this warranty is not valid:

  • Abuse or mishandling
  • The product is used for something for which it was not designed (misuse)
  • Wear and tear beyond the design intentions of the product
  • Adverse environmental conditions
  • The product has been altered or modified
  • The fault was caused by the use of accessories or supplementary parts that are not specifically certified to work by the product manufacturer
  • An inappropriate power supply or battery has been used
  • Inadequate care and maintenance

 

OTHER INFO

Sound Buddy has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services.

You further acknowledge and agree that Sound Buddy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

On buying a product, you are protected by legislation such as the Sale of Goods Act 1979 (as amended). If the product is not, when sold, of satisfactory quality or fit for purpose, you have a right to claim for repair or replacement for up to 6 years (5 in Scotland). Within the first 6 months, the retailer must prove that the goods you bought met the necessary standards. After the first 6 months, it is up to you to prove that the product was faulty when supplied: this may involve you taking legal proceedings.
